Website Terms and Conditions of Use

These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the website operated by Just PC's CC (“the Provider”), currently found at justpcs.co.za, or such other domain or temporary web address (including a myshopify.com address) from which the Provider makes the Website available from time to time (“the Website”). By accessing and using the Website, the User agrees to be bound by these Terms and Conditions. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the Website for marketing or other purposes without the consent of the Provider.

Who You Are Dealing With

The Website is operated by Just PC's CC, a close corporation registered in South Africa under registration number 2004/060554/23, VAT number 4600249660, whose office bearer is JJ van der Walt. Our physical address, and the address at which legal documents may be served on us, is Unit 5, Brackengate Business Park, 6 Paris Road, Brackenfell, Cape Town, Western Cape, 7560, South Africa. These Terms and Conditions can be accessed on this Website at any time, and may be saved, downloaded, or printed using your browser's standard functions. A copy of your order confirmation and tax invoice will be emailed to the address you provide at checkout; please keep this as your record of the transaction. Just PC's CC does not currently subscribe to an alternative dispute resolution scheme or code of conduct. If you are a consumer, you have a right to cancel certain orders without reason within 7 days of delivery — see “Order Formation and Pricing” and our Refund Policy for how this works.

Electronic Communications

By using this Website or communicating with the Provider by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

Order Formation and Pricing

Prices displayed on the Website are an invitation to do business, not an offer. Placing an order is an offer by you to purchase the listed product(s) at the displayed price. A sale becomes binding only once we send you a dispatch or ready-for-collection notice for that order — until then, no contract of sale exists. We may decline to fulfil an order, in whole or in part, before that notice is sent, but only for one of the following reasons: the product is no longer available or in stock; the price or description on the Website contained a manifest error; we cannot verify or process your payment; or we reasonably suspect the order is fraudulent. If we decline your order for any of these reasons, we will notify you within one business day and refund any amount you have already paid in full within seven days. This clause does not affect your statutory rights, including your 7-day change-of-mind right described in our Refund Policy.

The provision of goods and services is subject to availability. Where we are genuinely unable to supply an order that has already been accepted (i.e. after a dispatch or ready-for-collection notice has been sent), we will refund the client in full within 7 days.

Cancellation of an accepted order by the client may attract a charge of up to 10% of the order value to cover administration costs, having regard to the notice given and whether the goods can readily be resold to someone else. No cancellation charge applies where the client cancels due to our own delay, error, or non-performance, where the client is exercising the 7-day change-of-mind right described in our Refund Policy, or where the client is unable to honour the order because of death or hospitalisation.

E-Commerce & Privacy

The Website justpcs.co.za sells refurbished IT equipment online. The private information required to fulfil orders placed through the Website — including personal information, delivery address, and telephone number — is handled in accordance with our Privacy Policy. Only the information necessary for delivery (name, delivery address, and contact number) is shared with our delivery partners. We do not store your full payment card details; these are processed directly by our payment provider.

The Provider cannot be held responsible for security breaches occurring on the User's own electronic device, including those resulting from a lack of adequate virus protection or malware the User may have inadvertently installed.

Any complaints regarding the standard or quality of a product bought through the Website should be sent to support@justpcs.co.za, and will be handled by the CEO's office.

Updating of these Terms and Conditions

The Provider reserves the right to change, modify, add to, or remove portions of these Terms and Conditions from time to time. Changes become effective once posted to this Website. It is the User's responsibility to periodically check these Terms and Conditions for updates. Continued use of the Website following a change will be treated as acceptance of that change, except where the change would remove a right you already hold in respect of an order already placed.

Copyright and Intellectual Property Rights

All content displayed on this Website — including but not limited to text, images, logos, and compiled product data (“the Content”) — is provided by the Provider, its affiliates, or third-party owners, and is protected by South African and international copyright law. The Provider reserves the right to change the Website, the Content, or the products and services offered through it at any time and without notice. Except as set out in these Terms and Conditions, the User is granted no licence or other right under copyright, trademark, patent, or other intellectual property law in or to the Content.

Limitation of Liability

The Website and its Content, including any current or future offer of products or services, are provided on an “as is” basis and may include inaccuracies or typographical errors. Neither the Provider nor any of its affiliates makes any warranty as to the availability, accuracy, or completeness of the Content. Nothing in this clause limits any liability that cannot lawfully be excluded or limited under the Consumer Protection Act, including our responsibility for goods that fail to meet the standard required by section 55, or for loss or damage caused by our negligence.

Privacy: Website Analytics

The User may visit the Website without providing any personal information. Our servers automatically log the User's IP address and similar technical information for the purpose of measuring site visits, average time spent, and pages viewed, so that we can operate and improve the Website. This information is handled under, and subject to the safeguards described in, our Privacy Policy.

Choice of Law

This Website is controlled, operated, and administered by the Provider from its offices within the Republic of South Africa. Access to the Website from territories where the Content or the products sold on the Website are illegal is prohibited. If the User accesses this Website from outside South Africa, that User is responsible for compliance with local laws. These Terms and Conditions are governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Western Cape Division of the High Court, Cape Town, in the event of any dispute. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to use of the Content and this Website.

Shipping and Delivery Risk

Full delivery timeframes, courier options, and costs are set out in our Shipping Policy. Where the client selects and arranges their own courier or collection service, and that courier collects goods from our warehouse, the risk of loss or damage in transit from that point is borne by the client — that courier is a third-party service, not provided by JUST PC's. Where JUST PC's arranges delivery on the client's behalf, JUST PC's bears responsibility for the goods until the client accepts delivery. In either case, if goods arrive defective, the client may return them for a repair, replacement, or refund under our Refund Policy and Warranty & Return Policy. Insurance is not included as standard; clients who would like additional cover should request it when placing their order.

Warranty and Returns

Promotions, Discounts, and Vouchers

JUST PC's reserves the right to limit the number of items purchased under any promotion and to end a promotion without notice. Stock quantity and pricing cannot be guaranteed for any promotion. E&OE.
