The device leaves. The liability doesn't.
Under POPIA section 14(5), personal information must be destroyed in a manner that prevents its reconstruction in an intelligible form. A factory reset does not meet that standard. Neither does a quick format.
Section 21 goes further. Where a third party processes personal information on your behalf, you are required to have a written contract binding them to your security standards — and you remain accountable. That obligation does not transfer with the hardware.
Most disposal companies grade your equipment and quote you a price. So do we. But the reason our clients sleep at night is the certificate that arrives afterwards, tied to a serial number, proving the data is gone.
Device owners remain responsible for data security and cannot transfer this obligation to recyclers or refurbishers.
Data wiping should meet NIST 800-88 standards at minimum, with destruction certification held as proof of compliance.
